Terms of Service

1. Acceptance of Terms

By creating an account or using EcomSpy ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

EcomSpy is an e-commerce competitive intelligence platform that provides data about publicly available Shopify stores, including store information, product data, advertising activity, and related analytics. All data is collected from publicly accessible sources. The Service is accessible through the website and, for subscribers, through an API and an AI-assistant (MCP) integration.

For subscribers, the Service also includes:

• Store tracking and notifications — you can track stores and be notified of changes, in the app, by daily email digest, and optionally via a Slack or Discord webhook you configure.
• AI-generated analysis — automatically generated estimates of a store's advertising and campaign structure, produced by third-party AI models.
• TikTok organic data — information about publicly visible TikTok profiles and content.

3. Accounts

• You must provide a valid email address to create an account
• Email signups must be verified within 7 days; unverified accounts are automatically deleted after that period
• You are responsible for maintaining the security of your account credentials, including any API keys you generate
• You must not share your account or API keys with others
• We reserve the right to suspend or terminate accounts that violate these terms

4. Subscriptions and Billing

• Access to full store data requires an active paid subscription. Without a subscription, the store list shows only a redacted preview and individual store detail pages, change history, and ad data are not accessible.
• Store tracking, notifications, and AI-generated analysis require an active subscription.
• Programmatic access — including the API and AI-assistant (MCP) integration — also requires an active subscription and a verified email address.
• Subscriptions are billed on a recurring basis through Stripe
• You can manage your subscription and payment methods through the billing portal in your account settings
• Cancellations take effect at the end of the current billing period
• We do not offer refunds for partial billing periods

5. Tracking and Notifications

• The number of stores you can track is subject to a per-account limit and to overall platform capacity. These limits may change.
• Notifications — in-app, email, and webhook — are provided on a best-effort basis. We do not guarantee that any notification will be delivered, delivered on time, or that every change to a tracked store will be detected.
• If you configure a webhook, you are responsible for the URL you provide and for ensuring you are authorised to send content to that destination.
• You must not rely on notifications for any time-critical or business-critical purpose.

6. AI-Generated Analysis

Parts of the Service — including campaign-structure analysis and related summaries — are generated automatically by third-party AI models. This output consists of inferences and estimates, not verified fact. It may be incomplete, misleading, or wrong, and it may change between runs for the same store.

AI-generated analysis is provided for informational purposes only. It is not business, financial, legal, or professional advice, and you should independently verify anything you intend to act on. You are solely responsible for decisions you make based on it.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to scrape, copy, or bulk-download data from the Service
• Resell or redistribute data obtained from the Service without permission
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or its infrastructure
• Create multiple accounts to circumvent subscription requirements
• Use tracking or webhooks to send unsolicited or unauthorised content to any destination
• Abuse the in-app feedback form (it is rate-limited to a small number of reports per user per day)

8. Data Accuracy

The data provided by EcomSpy is collected from publicly available sources and is provided "as is". We make reasonable efforts to keep data accurate and up to date, but we do not guarantee the completeness, accuracy, or reliability of any data. Store information, ad counts, and scores may change at any time and may not reflect current real-time data.

Some data is derived or inferred rather than observed — including scores, rankings, trend indicators, and AI-generated analysis. Derived data is an estimate and should be treated accordingly.

9. Intellectual Property

The Service, including its design, features, and functionality, is owned by EcomSpy. Store data displayed on the platform is sourced from publicly available information and remains the property of the respective store owners.

10. Limitation of Liability

EcomSpy is provided "as is" without warranties of any kind. We are not liable for any damages arising from your use of the Service, including but not limited to business decisions made based on data, notifications, or AI-generated analysis provided by the Service.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause. Upon termination, your right to use the Service ceases immediately.

You may permanently delete your account at any time from Settings → Danger zone. Deletion is immediate and irreversible, and any active subscription is cancelled at the same time. Consistent with section 4, we do not refund the remainder of a billing period you have already paid for.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms.
